Florida License Reinstatement After DUI — Complete Checklist (2026)
Print this page. Keep it with your court documents. Check off each item as you complete it.
PHASE 1: IMMEDIATELY AFTER ARREST
- Days 1–10: Request formal review hearing from DHSMV — call (850) 617-2000. This buys time and extends your temporary permit while hearing is scheduled. Missing this deadline = hard suspension starts day 11.
- Hire a DUI attorney — not optional for best outcome. An attorney can negotiate, arrange diversion, or challenge evidence.
- Document everything: arrest date, case number, county, officer names, BAC results if given
PHASE 2: AFTER CONVICTION OR PLEA
- Get your court disposition document — from the clerk of court. Shows conviction, sentence, and conditions. You'll need this.
- Enroll in DUI school: Level I (12 hours, ~$270) for first offense / Level II (21+ hours) for second offense or BAC 0.15+. Find approved providers at flhsmv.gov.
- Complete DUI school — school transmits completion to DHSMV electronically. Get your certificate anyway.
- Complete substance abuse evaluation if ordered (Level II school triggers this)
- Complete all treatment requirements if recommended by evaluator
- Complete community service hours if ordered by court
- Pay all court fines and costs — get written confirmation from clerk that your balance is $0
PHASE 3: FR44 INSURANCE (DO THIS ASAP)
- Determine owner vs non-owner policy: Own a vehicle? → owner policy. No vehicle? → non-owner ($18–$45/month).
- Get FR44 quotes from multiple carriers — pricing varies 30–50% between insurers
- Purchase FR44 policy — must meet $100K/$300K BI + $50K PD minimums
- Set up AUTO-PAY immediately — one missed payment = lapse = suspension + clock restart. Non-negotiable.
- Confirm DHSMV received FR44 filing — call (850) 617-2000 or check flhsmv.gov within 48 hours
PHASE 4: IGNITION INTERLOCK (IF REQUIRED)
- Determine if IID is required: Mandatory for BAC 0.15%+, minor in vehicle, or 2nd+ offense
- Select DHSMV-approved IID provider — Intoxalock, Smart Start, LifeSafer are common
- Schedule and complete IID installation — typically 1–3 business days lead time
- Register IID with DHSMV — provider typically does this; confirm
- Keep all calibration appointments — required every 60 days
PHASE 5: DHSMV REINSTATEMENT
- Pay DHSMV reinstatement fee — $150–$500 depending on offense. Pay online at flhsmv.gov or at DHSMV office.
- Confirm all requirements met: DUI school ✓ | FR44 confirmed ✓ | IID installed (if required) ✓ | Fees paid ✓ | Treatment complete (if required) ✓
- Apply for reinstatement — online at flhsmv.gov or at DHSMV office
- Receive reinstated license — 24–48 hours processing after all requirements confirmed
PHASE 6: DURING 3-YEAR FR44 PERIOD
- Maintain FR44 continuously — zero tolerance for lapses. Auto-pay. Update card numbers when they expire.
- Comply with IID for full required period — don't tamper; don't miss calibrations
- Complete probation — report as required; fulfill all conditions
- Re-shop at Year 1 and Year 2 — rates often drop as conviction ages
- Month 36: Confirm FR44 period ended with DHSMV — then request FR44 removal from insurer and shop standard market policy
